Exploitation rights in the software and documentation developed under a commission pass to the client on the terms, scope, territory and term set by that commission’s written contract, in accordance with Articles 43 ff. of Royal Legislative Decree 1/1996 (TRLPI), which requires the assignment to be in writing. The author’s moral rights are inalienable and cannot be waived (Article 14 TRLPI) and are unaffected by that assignment. Third-party and open-source components incorporated into a delivery keep their own licences, which are listed in the delivery documentation. Nothing published on this site is itself an assignment of rights: the assignment happens in the contract, not on the page.
